Ross Graham Thomas v. Joseph Foyst (24A-MI-251)

Ross Thomas successfully challenged Joseph Foyst’s candidacy for the Columbus City Council District 6 seat because he missed the filing deadline. Foyst and the Bartholomew County Republican Party declared Foyst the candidate a second time. Thomas sued, seeking declaratory and injunctive relief to prohibit Foyst’s appearance on the general election ballot. After Foyst won the election, the trial court denied Thomas relief. The Court of Appeals reversed and declared the Democratic candidate the winner. Thomas v. Foyst, 239 N.E.3d 95 (Ind. Ct. App. 2024), trans. pending.
