Cobia Solar LLC has filed a Verified Petition for Judicial Review in Jennings County Court, challenging the Decatur County Board of Zoning Appeals’ August 6, 2025, decision to deny its application for a special exception to construct a solar energy facility west of Greensburg. The company argues the BZA acted arbitrarily and without substantial evidence, claiming its project met all zoning requirements and was supported by more than 5,600 pages of documentation, expert testimony, and agreements with county officials. In the filing, Cobia alleges the board improperly relied on speculation and community opposition rather than the ordinance’s standards and contends the denial was “arbitrary, capricious, and contrary to law.” The appeal asks the court to overturn the BZA’s decision and direct approval of the project.
