Court Rejects Motions to Dismiss on Counts I & II, and Change of Venue in State v. Christian Rust

On October 6, 2025, Decatur County Superior Court Judge Matthew Bailey denied two motions filed by attorneys representing Christian Rust: a motion for a change of venue and a motion to dismiss Counts I and II of the case. Both motions were previously argued during a hearing held on September 15, 2025.

Rust served as the previous Washington Township Trustee in Decatur County, Indiana.

The two counts that were denied for motion to dismiss were:

  • Count I: Theft, in violation of Indiana Code 35-43-4-2(a)(1)(A).
    • Judge Bailey stated that the charging information tracks the language of the theft statute.
  • Count II: Official misconduct, in violation of Indiana Code 35-44.1-1-1(1).
    • Judge Bailey stated that the language of the charge mirrors the official misconduct statute.
