Decatur County Area Plan Commission

The Decatur County Area Plan Commission met on Wednesday.

Christian Martin requested to subdivide 7 acres out of 44 acres and rezone 2.99 acres from that 7 from an A-1 to an A-2 zoning classification for the construction of a single family detached dwelling. They will be on rural water and the septic has been approved. The property is owned by Janet Schwering in Greensburg, Marion Township. Petition 2022-12 was approved.

Eric and Pamela Sample requested to rezone 2.99 acres out of 6.725 acres from an A-1 to an A-2 zoning classification for the construction of a single family detached dwelling. They will be on rural water and have a good driveway access point. The property is owned by the petitioners in Westport, Sand Creek Township. Petition 2022-13 was approved.

Bill Finley came to the board to discuss ordinances regarding the Hillbilly Corner property. Finley wanted to try and make sure that every option has been fully discussed before the rezone from an A-2 to a B-2. This is because Finley, as well as the other neighbors according to him, do not want a B zoning near them. There were several questions asked to the board. Can there be conditions put on an A-2 zoning that could allow conditional use? The answer is no because of the current ordinance wording. Why would the rezone be a B-2 rather than a B-1 as it has some qualifications the business is looking for? This is because of the retail sales and sale of food items which qualify it as a B-2. Can the board put a conditional on a B-2? No due to the current ordinance. Why can’t they change the current ordinance? They can change the ordinance but it is a lengthy process. The board stated they always appreciate this feedback as it helps them to look at and know what to look for when it comes to the ordinances and what needs changed. However, the state does not allow for conditionals or commitments to be attached to a rezone.

Petition 2022-7 for Hillbilly Corner was tabled.
